Question: It is said that we all make a variety of contracts every day. How can this be? How do we make agreements without actually necessarily saying anything to another party or even determining the terms of these agreements?

ANSWER:

Contracts can be described as an agreement entered into by two or more parties that intend to form a legal binding on each other. Such contracts could be written or oral. It is not necessary for all contracts to be written and hence, it can be said that it is easy to enter into variety of contracts each day. Written contracts take a longer period of time to get executed but this is not the case with respect to oral contracts.These agreements are oral agreements that the had entered into through words or gestures. Although the legal enforcement is much less as the burden of proof becomes difficult to achieve, it is still considered as a valid contract entered into by parties and can be expressed or implied in nature.

When contracts are made through actions of either of the parties, it can be defined as an implied contract which is executed without expressly stating it.For instance, nodding one's head to another's offer can be construed as a valid implied contract.In such cases, the offerree accepts the offer made by the offeror and enters into a valid agreement.
